The UKIPO provides an online application service that individuals and businesses can use directly. For some applicants, paying the official fee and handling the process themselves is entirely proportionate. For others, the apparent saving is small compared with the value of the brand or the cost of correcting an avoidable problem.
The practical comparison
| Issue | Direct application | Attorney-prepared application |
|---|---|---|
| Initial cost | £205 UKIPO fee for one class | Professional fee plus the official fee |
| Owner | You decide who applies | Ownership details are reviewed before filing |
| Mark | You choose the version filed | Word, logo and filing strategy are considered |
| Classes | You select classes and wording | The specification is professionally prepared |
| Earlier rights | You assess search results and risk | The appropriate search and risk level can be discussed |
| UKIPO correspondence | You monitor and respond | Routine stages are managed and reported |
| Objections or opposition | You decide how to respond | Options, strategy and further costs are explained |
When direct filing may be reasonable
A direct application may be proportionate where:
- The brand is temporary, experimental or of limited commercial value
- The applicant understands who should own the mark
- The mark is distinctive and does not appear descriptive
- The goods or services are narrow and straightforward
- The applicant is comfortable searching earlier rights and accepting the risk
- The cost of rebranding would be relatively low
Even then, the applicant should read the UKIPO guidance carefully and keep a record of the commercial reasoning behind the specification.
When professional preparation is more valuable
Using an attorney becomes more compelling where:
- The name is central to the business or a planned investment
- Packaging, premises, software or advertising will be committed to the brand
- Several owners, founders or companies are involved
- The mark might be descriptive or allusive
- The business spans several classes or territories
- Earlier similar marks have been identified
- The business expects licensing, investment, sale or international expansion
- Changing the brand later would be disruptive or expensive
Why is the form not the whole job?
The online form records the decisions; it does not make them. Before submission, someone must decide:
- Which legal person should own the application?
- Should the business protect the name, logo or both?
- Which activities belong in the specification?
- How broad can the wording sensibly be?
- Are earlier rights a commercial problem?
- Which territories should be prioritised?
Once the application is filed, important aspects cannot simply be rewritten. In particular, goods and services generally cannot be added. A further application may be required if the original scope was incomplete.
What about very cheap online filing services?
Online providers offer different levels of service. Some provide genuine professional advice at a competitive price. Others mainly transfer information supplied by the customer into the registry form. A low headline price may also exclude the official fee, VAT, extra classes or post-filing work.
Before paying, check who is professionally responsible, whether the specification will be drafted or merely copied, what form of search is included and which later stages are covered. Our UK trade mark cost guide explains how to compare the complete price.
What does TRD do differently?
TRD is designed for applicants who want a streamlined online process without reducing the work to form submission. The £749 UK package includes the official fee for one class, UK VAT, ownership review, preliminary mark review, class selection, specification preparation, filing and routine reporting through examination, publication and registration.
Substantive objections, oppositions, detailed clearance opinions and hearings are outside the routine package. If one arises, we explain the options and agree any additional work before it begins.
A sensible decision test
If the answer is “we could easily choose another name”, direct filing may be reasonable. If the answer involves replacing packaging, changing a website, disrupting customers or jeopardising investment, professional preparation deserves greater weight.
Cost is still relevant. The professional fee should be transparent and proportionate. But it should be compared with the value being protected, not only with the number of boxes on the application form.
