What the extension changes

The development brings Jersey within the Madrid framework. It gives eligible international trade mark applicants and owners a centrally administered route for seeking protection that extends to the Bailiwick.

As with every Madrid designation, the international registration remains a collection of territorial rights. Local law determines whether protection is accepted, refused or later challenged.

Fees and procedure

Jersey has made a declaration under Article 8(7)(a) of the Protocol, allowing an individual fee to be charged for a designation and renewal rather than receiving a share of standard supplementary and complementary fees.

Applicants should check WIPO’s current fee calculator and the latest information notice at the point of filing. Official fees can change, and the correct designation strategy depends on the territories already covered by the portfolio.

Portfolio review

Businesses trading in Jersey should check whether their present registrations already provide the intended protection and whether a Madrid designation is available and commercially worthwhile. The registered owner, mark and list of goods and services must align with the international registration on which a later designation is based.

For a new brand, clearance remains essential: joining the Madrid System changes the filing route, not the substantive test for registrability or infringement risk.
